Malta

Individuals can apply for a copy of their own Conduct Certificate which are issued by the Police Criminal Records Office in Malta in accordance with the Conduct Certificate Ordinance, Chapter 77 of the Laws of Malta.

Application Procedure

If applying from within Malta

An individual living in Malta must call in person at the Criminal Records Office in Malta. The individual must provide a passport or identity card as proof of their identity.

The individual must also enclose payment with their application. The conduct certificate will be produced 'while you wait'.

If applying from the UK:

A Maltese national, UK national or foreign national living in the UK who has spent a period of residence in Malta can apply for a Conduct Certificate, by sending a request in writing to the Commissioner of Police at the following address:

The individual will be required to provide their full particulars as mentioned above, and will also need to send an authenticated photocopy of their passport as proof of their identity. A photocopy of the passport should be authenticated by a Notary Public and in order to do this an individual must attend in person before the Notary. There are no set fees for this service but some Notaries may charge as much as £60 for the authentication. A list of Notaries may be obtained by contacting the Notaries Society at the following:

There is no requirement to specify the reason for the request.

Cost

The cost of making an application is 2.33 Euros made payable to the Commissioner of Police.

If applying from the UK, an international Money Order for the above amount is acceptable, made payable to the Commissioner of Police.

Content of certificates

The Conduct Certificate will show the individuals’ full name, date of birth, identity card number and any other particulars which can identify the person mentioned in the certificate, and will contain either:

• a declaration made to the effect that the person mentioned in the certificate is of good conduct; or
• a declaration made containing the recordable convictions against the person mentioned in the certificate.
• Certain convictions will not be entered onto a certificate if -
• it refers to any contravention; or
• the person convicted of a crime was at the time of its commission under twenty one years of age; or
• the pardon of the President of Malta has been granted in respect of that conviction; or
• it is made under the provisions of the Probation Act
• depending on the nature of the crime, the circumstances in which it was committed, and the conduct of the person convicted, the court may direct that the conviction should not be recorded.

Furthermore, some convictions will not be recorded on conduct certificates after a specified period of time. The timescale for the non-disclosure of such convictions are specified in regulations, although there are exemptions to this rule where certain convictions will be disclosed on the certificate.

Turnaround time

For applications made in Malta, the certificate will be produced 'while you wait. If applications are sent from the UK, the Police Criminal Records Office will endeavour to respond within a week, although additional time taken to send and receive applications by post should be taken into account.
